Terms of Service

These Terms of Service ("Terms") govern your access to and use of TechForest LLC products and websites, operated by TechForest LLC, a Massachusetts limited liability company ("Company", "we", "us"). By creating an account or using our services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using any TechForest product or website, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. Description of Services

TechForest LLC develops and operates software products including RetireQuest, an educational financial planning tool that helps users track expenses, model debt payoff, and project retirement timelines. Our services are provided for informational and educational purposes only.

3. Eligibility

You must be at least 13 years old to use our services. By using our services, you represent that you meet this age requirement. Our services are primarily designed for U.S. residents; use outside the United States is at your own risk and may not comply with local laws.

4. User Responsibilities

You agree to:

• Provide accurate information when using our services
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Use our services only for lawful personal purposes
• Not attempt to reverse engineer, scrape, or abuse our services or infrastructure

5. Account Termination

You may delete your account at any time through your account settings. We may suspend or terminate your account, with or without notice, if you violate these Terms or our User Policies, or if your use poses a security or legal risk to the platform or other users. Upon termination, your data will be deleted in accordance with our Privacy Policy.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CALCULATIONS WILL BE ACCURATE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TECHFOREST LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

8. Indemnification

You agree to indemnify and hold harmless TechForest LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of our services or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction in those courts.

10. Arbitration

For any dispute arising out of or relating to these Terms or our services, you and TechForest LLC agree to first attempt to resolve the dispute informally by contacting us. If informal resolution fails, disputes shall be resolved through binding individual arbitration under the rules of the American Arbitration Association, conducted in Massachusetts. You waive the right to participate in class action lawsuits or class-wide arbitration.

11. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date. Your continued use of our services after the effective date constitutes acceptance of the updated Terms.
